Whats happening with the Bag reduction Herring - bloody abuser

Rumours had it the bad limit was going to be reduced. Heard nothing further.

Reason is heard the herring was firing in the cut, so went for a gander.

Sure was  with double headers etc.

However one particular (race not mentioned) had a bucket full that on gestimation would have had way way more than 30 in it. I kindly asked how many have you caught, looks like fun. Answer heaps, perhaps 60odd. I then said wow, but isnt there a limit, adding I think 40 (not 30 as I knew). But Ill check with th Phone. No I was wrong its 30 I said. Then told to bugger off and dont be so nosy.

I smartly said you should fish for the future and not exceed the set limits. There is 3 off us fishing she replied. Where is the others, because if I dont see them in 10minutes Im calling fisheries.

She then packed up the car, and Oh my god, there was 3 other buckets in there stuffed to the brim with herring. She moved the car to the other side of the parking bay (I thought she was leaving), brought a now empty bucket, and you guesed it, started fishing again.

Now Im pissed off lady and called the hot line, gave them the rego of the car. Was advised by watch that the officers were involved all in a big sting operation and might take time to get there. Do I feel confident doing something about it. knowing the law about trespassing in someones car I wasnt about to tip the buckets in the car overborad, but every fish she landed I tried to throw back. Then some Gray nomad walked over to see what was happening because she was yelling abuse at me. Im taping this on the phone after fisheries requested this. When the older gents came over her gave her a mouthful probably bigger than me, told her he fished there everyday, and that him and his mates was going to toss her in the drink if they saw her there, every. Starting now. As mentioned got the car Make, colour, rego, and as the bonnet was opened for whatever reason I got a Vin and body plate aswell.

Now she F*&*%^$d off to a few cheers. I was steaming, the old man name Paul was boiling, a mate of his was making rude gestures to her, and anothe chased her with a sizable fish pacifier to her car.

I might now stop by after work, wednesday midafter after half day, and if I see the crow she will have her fish confiscated. Fisheries sending me a badge saying I can.

That just bloody outraged me. In the 4 white buckets I would gues 50-60 in each, plus the 2 she managed to get in her bucket after we pilfered her catch.

Hope with all the info she gets busted because she wasnt aware we forwarded all the identifying details to fisheries. Did it on the sly.

This has pissed me off all night.

If I possible get a badge as a responsible bag follower, why cant we set up a fisheries help mob like the old VFLO(Edited) previous. No power to arrest, but to confiscte eand dold until Police and cops turn up.

Nice work on reporting her to fisheries, not sure on your ability to legally confiscate her catch or interfere with her fishing.

Reasonably sure that Fisheries Officers are sworn into the position and given their powers by the head of department as acting on his or her behalf, this would require anyone carrying out those duties to be an employee of Fisheries WA. You mentioned that they are sending you some sort of identification which empowers you to carry out confiscation of catch (which is effectively seizure of goods), just make sure the person who you spoke to knows what they are talking about and that the ID they send you has your photo and the legislative act under which you can perform a seizure attached to it (usually printed on one side of the ID).

I can't stand overfishing and in principal agree with your thoughts on how people like this should be dealt with, BUT (as in sir mixalot size) I don't think it's a good idea to operate outside of the very law that you are trying to uphold.

Hope they catch the b!tch and she's in the prosecution section of the next fisheries newsletter.

Im a Doc so not likely to want to or will break a law willingly. And wasnt sure about this "Deputy" badge (I have never heard of it, and sounded a little like it was said by someone at fisheries "on her first day -sounded very young!!!). However when she dropped the heezza;s on the deck they werent in her possesion and we retuned them to the water. Forgot to say she also stomped on blowies and left a pile to - poison our dogs walking past, - leave stinking mess, and -pollute the area for other fishers. I know I wasnt right but with steam coming out I told her that it is illegal in Australia do be cruel to animals, and not only will fisheries hear about it, but also the RSPCA - it made her look at me like I was a madman (which i was at that stage).

And you think I was angry. Should have seen the law abiding 3 old men buddies. Look like they were about to kill her. Some others just stoof by and watched/laughed at the commotion. Some sad comments flew her way like "piss off to your own country", "arrived on a boat hey" etc which was a little OTT.

 The same type of Australians were taking boot loads of 5kg salmon at Cheynes Beach at Easter. The buggers camped in their cars, loaded the boots full up and did a drop off runner only to return for the same gig. No care for the fish, left in sun for ages.

obvious they were fishing for the local restaurant.

yep very nice work Crasny1 and well handled - i was getting pssed of just reading that story, my dad taught and stamped that into me in the early stages of fishing - i remember him throwing a bloke and his fishing gear into the drink one day at the north mole for doing the exact same thing, think i was about 7 - but now i get why he was so angry.

The Good/Bad Old Days

I remember those days (I was 6 years old) when everyone would roll down to north freo warf at the first sign of bad weather, yellow pvc wet weather gear, bamboo fishing rods and people standing shoulder to shoulder waiting for the swan to empty out the first mulloway of the season. Lots of people took more than what was edible within a week and many others were happy to catch just the one and go home soaking wet. The difference back then was there weren't any bag limits, for the most part people didn't know any better, there was always plenty of fish around and alot of people didn't really see it as overfishing, they just saw the big catches as something that just happened. I do remember the odd stoush between fishers about the amount of fish that were being taken by a single person but it didn't really happen often enough (at that time) for those people to change their ways.

It's more than likely that those times are why things are so hard now (in comparison to then), the biomass for the swan will probably not ever have enough ease on the pressure to properly replenish.

 Well done mate,heard of a similar story a year or two ago except it was a boot load of crabs from mandurah.Heard it from a fisheries officer,they were tipped off and arrived at the house before the car.Upshot of it was car confiscated and huge fine,couldnt understand english at first but when the big stik came out low and behold suddenly understood,driver of the car was a Dr i think.

At least you did every thing you could mate. I have called fishwatch many times and have never had a result, gave them rego etc and even emailed pictures.

Volunteer fisheries,  I remember them and had a few run ins with them too, had them offer to buy fish and crays plus some real dodgy offers to sell me certain items. They were reported too and found out later one was arrested from other complaints. We might all have the best intentions but there will always be people who would abuse any power given to them, they become no better than vigalanties or fall to corruption.

As far as reducing the Herring bag limit , i don't agree. They are part of a mixed bag and just because they wernt around for a while dosn't meen they are in low numbers.( more to do with water temp i think )  I have been getting my bag in less than an hour and havent seen them this thick for years from the shore.

 I used to be a VFLO and got sick and tired of people wanting to punch me in the head for educating them on bag limits etc. Never took anything from other people and we could aways phone the fisheries and let them know if there was stuff happening and they would get there as fast as they could, but that dropped away after a while too.

I think you did a bloody great service to responsible fishermen and women. I live in Falcon and on a day when the sth westly wind is blowing you can smell the cut. The amount of dead squashed blowies and bait that is left laying around is bloody disgusting. As for people taking way over the bag limit for various species of fish it really gets up the nose of those who believe in fishing for the future. There was one old bloke who I was fishing next to one day and we had both caught about a dozen herring, I started to packup and getting ready to call it a day as I had caught enough for a meal, the old guy says "why are you quitting they are still biting and you haven't filled your bucket yet". I asked him how many did he plan on catching the response made me see red and become very abusive his response was "when the bucket is that full that I have to ask for help to carry it then it's enough" When he could get a word in he said that he always caught a lot so that he could give all those in his nursing home a feed. Commendable gesture, but the bag limit is put on your catch for a very good reason not sohe could play at being some one on the mountain feeding the gathering. I think it's a shame that you don't see any FLOs any more they had a sobering effect just by being seen in the fishing area.

...by the sounds of it, she was the exception rather than the rule. The old timers that gave it to her very likely were fishing in the days when there were no bag limits but are more than happy to do the right thing nowadays.

 

Well done, mate, you clearly did everything you possibly could without going up on an assault charge!

 good on ya mate it reminds me of when i was about 18 a mate and i havin a bream sesh in the swan werent havin much luck so shout round to a jetty i new pretty crowed so left the rods in thecar and thought we'd have a sticky this was bout 10pm all was good bar 1 bloke with his mate that had 15-20 black bream no bigger than 15cm in the bucket. i asked very politly that they should go back, to this i got a mouth full. no worries i said, he turnred, around i sent the bucket strait in the drink he spun round hands up ready to go i made 2 very quick steps towards him, he took 2 back and...... splash he was in the drink with his mate apolagisin to 2 very pissed off fishos got manny laughs that night and a few thankyous aparently they were quite rude to the locals who asked them 2 return fish havent seen em there since

Called fisheries and house raided. They didnt get her redhanded with th 4 buckets.

From what I hear second hand from a fisheries mate is they found not only was excess herring, whiting, Abs, gardies, "speared" mullet, some small skippy.

Arguement was from now a few off them it was caught on heaps of days by different people. Problem 30kg+ total in the freezer, and abs not frozen, ie fresh and alive. Also found more than 9 litres of still live prawns (might have been 18l) in the kitchen.

My photos and the tape recording during which it is clearly heard from her, myself and the old dude is the 4buckets of herring is pillaging the ocean. Dumb enough also to say she was going to fill the fifth bucket and us berating her over this. "plent out there and I am going to get more" clearly heard from her Got the name of the first gent and he knows the other 2. Asked me if I would witness with a stat dec, my photos and the tape. What do you think I said. Blood oath. And the other gentlemen will get a call from me or fisheries regarding the same and I think he is much more likely to want to throw the whole book as he was almost red with rage, and "im going to court to screw this Mongrel".

Potential fine: >20kg in freezer, freshly caught abs , out of season and "ha ha" no licence, and double the allowable amount of prawns. Mullet caught illegally. Could be a nice punishment following ha ha.

Will watch the fisheries cases reported with glee. And if I see her there again call fishwatch first, go up and down the line and tell every fisho there what happened previously. Might slowly push into her territory and push her off. Chucking her in the drink might just backfire on us - but I sure as hell am very very tempted.

 People like this make me sick, they deliberatley break the rules and when anyone confronts them they act like they dont know whats happening. Cant belive it 30-40 in each bucket wtf was she thinking, unfortunately to most casual fishos like this they only enjoy themselves if they are constantly catching. Killing thier limit instead of limiting thier kill. Good on u for stepping in and having a worr, recording and getting her busted. People like this dont deserve to fish these beautiful waters.

 Was at the cut Sunday morning and saw a woman (not saying race) fill an esky full of herring plus another two buckets. Wasn't sure about limits because was mainly going for salmon but thought that she had had enough for a feed or bait. Didn't say anything to her because didn't want to upset anyone. People were getting upset but I was gone before any raging probably.

Good on you for doing something about it. People who don't bother because they don't want to upset someone are a disgrace to this country. I go down there every now and then and if I seen someone doing that, no matter what race, had a knife etc would speak my mind and let them know this shit is not on. If they want to get upset and abuse people because they are guilty, let them, I doubt they will assault or stab someone over it as then there would be an assault/occasioning bodily harm charge added. Don't be afraid to stick up for our country before it really turns to shit.
