Spear fishing with a hand spear.

Hey guys, is a 14 year old allowed to go down to the beach with his friends with a hand spear to go fishing as i have now got into free diving and i want to buy a hand spear, so am i allowed to use one at the beach, or even allowed to take one, cheers.

No problems with using one. Probably just be a bit careful about how you carry it around. If you were going to take it on the bus or similar I would remove the head off it as a minimum. Can be classified as a weapon but only if your acting irresponsibly.

You can't use them at all on some beaches, an example would be the Marmion Marine Park prohibits spearfishing within 1800m of the shore, so that covers Trigg Island right up past Burns Rocks.

No doubt there are similar zones around the metro coast, perhaps Metams Pool?

there's basically fark all places where you can go shorebased. check the dec website, basically anywhere decent is a marine park and like till says must be 1800m offshore etc etc. the regulations don't distinguish between a hand spear / gidgie or speargun.

these type of querys have come up numerous times before on this forum  so do a search and i'm sure youll find out the info you need

Would i be able to use a spear gun out the front of Marmion Angling and Aquatic Club? or is that Marmion marine park? (i might buy a speargun if I'm allowed to spearfish there). Cheers.

best place for shorediving is point peron, u cant usea  hand spear though, spearguns only, apart from there ur looking at going north quite a bit or south

Haven't looked into it in depth but as far as i've always know spearing is spearing, never heard of a rule where guns weren't allowed but gidgee's were or vise versa.... except for the old rules for cobbler in estuaries and rivers
