Four wheels drives and quads dont mixed

Myself and colin hay was heading back from our fishing spot, Came to a narrow dirt road with bush each side of the road 

And from about 8 foot away a quad came flying around from behind the bush,   [And I stopped the car straight away,]    but he was going so fast he bounced off the bullbar, And tried to drive in to the bush on the drivers side of me and ended going down my drivers door And stopping right by the window

He bent my bullbar /STEEL/ Smashed my windsheld  and made some dents all along the drivers side Plus bonnet

His bike was rideable, But he had sore ribs///// But could of been killed if he hit the bullbar in the middle 

And the guy had no insurance

So beware guys, Cos this could happen to you

 it is classed as a road if it is open to and used by the public - could be wrong. Good luck. 

 

Edit - Just found this online -  road means any highway, road or street open to, or used by, the public and includes every carriageway, footway, reservation, median strip and traffic island thereon;

Would it be classed as a reservation?

Especially when half the roads are through private property where the people have cut down fences. The best thing that can happen IMO is that people keep things quite and deal with it that way. It won't be long before the GinGin Shire does the same as Wanneroo.. ban 4x4 access.

And still getting scratched to buggary. I move around a bit and probably don't fish the times you do. I have been restricted to afternoon sessions because I need to go back for more botox in the spine. I am almost crippled at the moment and a rough ride in makes things dramatically worse. My specialist has a wait list of about 6 months for regular customers..... Dammit. That's about how long the botox lasts.

While you were away I took a couple of weeks time out and rebuilt the top end of my motor. Heaps better now and also the ABS problem is fixed so no more aborted uphill efforts. Kalbarri in a few weeks mate so I hope to report some success up there.

no point trying to determine who's at fault...

The only concern I'd really have Sherbs is a possible injury claim related to your compulsory third party (death or bodily injury). I'd highly recommend reporting the incident to the coppers, particularly, if the other bloke appeared injured.

Report it to the cops asap and make a statement to back up ya story... sounds a bit over the top but ive been bent over with something like this before!!! at least it is official and he cant do a runner, i know i wouldnt want to be payin to fix my truck if it happened to me!! good luck.

Hey I agree with what everyone else is saying Sherbs , make a statement to the cops, quad bikers and x cross bikers piss me of when 4wd. They are not the only vehicles using the tracks also dont be a dickhead n fang the bike out if you cant see whats around the corner or clearly in front of you. Whats worse is it costs you money. That prick should pay up as it was his F up , fair enough it was an accident but that sort of shit happens because people dont think about the shit they are doing. Ps toyota's definatly eat nissans for  breakfast lunch an tea.

when i was slightly younger i hit a car in the pines with a motorbike, bloke had just parked and i hit him, as it was my fault i repaired his car out of my own pocket..... little did i know your on crown land insurance and every moral goes out the window, everyone at their own risk    good to hear everyone came out ok

Happened to me on a road. Kid comes flying out in the wet on a pushbike and doesnt see me, stacks his bike in the middle of the road, I brake go sideways and jackknife the trailor into the car. I stop 1m sideways from this kid. Got his number and everything. I did some research later in the day and find out hes on an unregestered vehicle with no insurance. I gotta pay for the damage.

Lucky I was doing 50 in a 50 zone or I would have run straight over him.

I am not sure insurance companies will pay for shit out there and I don't give you much chance with this dickhead unless he has a concience. As for the fist in the face theory I would suggest those people spend some time up there, especially overnight, and see what threats are about. People talk about Northbridge... staying up there with an attitude can get you hurt. That's why I move a bit further up these days.

driving on some of the tracks either north or south of Leeman, as there are a lot of quad, dirt bikes and dune buggies getting about.  I know the Shire has signs everywhere that they must be registered and all unregistered bikes, quads are illegal, don't know what shire you were in Sherbet.  Just wish they'd put a long pole with a flag on them so you can at least see them via the flag and blast your horn before they come hooning around a dirt bend.

it would seem pretty obvious a four wheel drive would more than likely be sticking to the designated road, track or path whereas themotorbike is more than likely going anywhere but the track.

i reckon if you went to the police you might find they can assist you in getting some compensation.

gotta be worth a try even for curiositys sake.

 to hear about the incident.As a " get to a fishing spot quad user" this type of thing really grates on me.

When me and the kids are on our quad ,im more aware and slower than when im in a 4x4 on narrow tracks.We use

a 2.5 metre orange whip pole and leave the headlight on.

The fishing type quads ,used responsibly by hundreds/maybe thousands of farmers ,retired dudes, and fishermen all over W.A

get lumped into the same hoon group , that no one likes, all the time.Not sure if your all aware but preston beach is now shut to all quads 

because of the hoon element.For many ,many years fellas have used there quads to quickly and efficiency fish 

that beach.My solution ,make offroad lic compulsary for all motorbikes/buggys ( its not at the moment), include a third party element

in it, based on

average use that most bikes would incurr ( alot less than most cars /trucks etc) to cover for accidents.Just like a skippers ticket 

why dont off road bike users have to obtain ticket of proficiency after a 1 day course.This way all bikes /buggys can be tracked,

the higher fees would discourage the hoon element, and the dicks can have there ticket cancelled.If this was the only way to 

ensure my continued use of my fishing quad ,id take it .

Guys lucky to walk away by sounds of it. Yet to face a quad on a narrow track at speed as you've encountered. But had some hoons in 4x4 run me off the road a few times. Then again i'm a culprit of taking it fast on tracks, but only when in remote areas where I know people are rarely seen, areas where i can view over the tops of bushes and open roads/beaches. 

Just wondering how you'd explain that to police, or the remorse you'd feel if he had killed himself. 

Quads are hard to be seen too, like above a pole and headlights would definitely help. I know if i did it regularly i'd be taking these precautions, being a 4x4 user on tracks.

Not good to hear at all sherbs, it could have been worse for all involved

Being up the 2 rocks way there is a high possibilty the track it was on is in the 4x4 allowed area. If this is the case depending on your Insurance company you could more than likely make a claim as off roading is covered by a majority of insurers as long as you a on a track and not "bush bashing"

If you have his details and a police report the Insurance company will persue him on your behalf. Seeing as you have a witness they will be able to verify the quad was at fault and that he should be paying for damages. With him also being 100% at fault you should not be p[enalised come renewal with increases.

It is an avenue to go down if the guy is being a trouble maker. If your with HBF i know some people.

 not good news. sounds like the guy was going a bit too fast for the tracks. one downside to this when your car is off getting fixed is you wont be out there fishing. at least the fish will have a break from your assaults
